Course Goal / Objective

Competition law is a branch of law built on rules established for the purpose of protecting competition in goods and services markets. The HKU.304 Competition Law course is designed to provide participants with a good foundation in contemporary competition law and the economics and politics underlying it. The course, which will be generally conducted within the framework of the substantive provisions of the Law No. 4054 on the Protection of Competition, will first provide participants with information about what competition law is, its basic purposes and scope. In order to better understand competition law, which aims to examine the actions and transactions of undertakings operating economically in goods or services markets and their effects, the basic issues will be explained and then horizontal and vertical agreements between undertakings will be examined. After understanding the dynamics that cartel agreements, joint ventures leading to cooperation and distribution agreements will create in the market, explanations will be made on dominant position and abuse of dominant position, another important concept of competition law. In the last part of the course, EU law regulations will be examined in general and the basic problems that the digital age has brought about in competition law will be determined. With this plan, it is aimed that the participants will be able to identify competition law problems and follow current competition law developments at the end of the course.

Course Content

In this course, the basic principles, purpose and application areas of competition law will be discussed and regulations aimed at protecting competition will be examined in detail. During the course, topics such as agreements, decisions and concerted behaviors restricting competition, abuse of dominant position, effects of mergers and acquisitions on competition will be discussed. In addition, legal and criminal sanctions regarding practices restricting competition, the duties and powers of the Competition Board, the process of examining and investigating competition violations, decisions that can be taken by the Board and judicial review of these decisions will be discussed in detail.
