Course Goal / Objective
The aim of this course is to examine the legal and criminal liability arising from occupational accidents within the framework of Law No. 6331 on Occupational Health and Safety, and to ensure that students acquire the ability to analyze the obligations of employers, employer representatives, and OHS professionals, to evaluate the legal consequences of breaches of these obligations, and to develop reasoned solutions to concrete cases.
Course Content
This course covers the concept, elements, and proof of occupational accidents; the obligations of employers, employer representatives, and OHS professionals under Law No. 6331; risk assessment, prevention and supervision duties and the legal consequences of their breach; pecuniary and non-pecuniary damages arising from occupational accidents and their calculation methods; recourse mechanisms within social security law; criminal liability related to occupational accidents, including negligent offences and multiple liability relations; and current issues and practical applications in light of judicial decisions.
