Course Goal / Objective

The primary objective of this course is to analyze the doctrinal foundations of insurance law within the framework of the Turkish Commercial Code No. 6102 and to examine the interaction between legislative provisions and judicial practice. In this context, it aims to provide students with a holistic perspective on how fundamental legal institutions—such as risk, indemnity, subrogation, and recourse—are interpreted in light of the established precedents and current rulings of the Court of Appeals, how they are applied to concrete cases, and the legal character they assume in response to evolving needs.

Course Content

Within the scope of the program, fundamental topics such as the formation of the insurance contract, disclosure and representation obligations, and the occurrence and proof of risk are analyzed with a focus on the recent precedents of the high courts. Furthermore, frequently encountered practical issues, particularly subrogation, recourse, and indemnity calculation methods, are examined. In addition, liability insurance and the adjudication processes of the Insurance Arbitration Commission are addressed within a theoretical and practical integrity, taking into account the shifts and transformations in judicial rulings.
