Course Goal / Objective

The aim of this course is to examine, in general terms, the concept of artificial intelligence, the transformation it brings to administrative law, and the issues it may potentially cause, within the framework of the principles and rules of administrative law. It is also intended that students develop the ability to analyze and resolve the problems arising in this interdisciplinary field from a legal perspective.

Course Content

The course mainly addresses the following topics in broad terms: the concept of artificial intelligence; the fundamental principles and rules of administrative law; the use of artificial intelligence in the establishment of administrative acts; the digitalization of public services and the role of artificial intelligence; the use of artificial intelligence in law enforcement activities; and the use of artificial intelligence and the liability of the administration.

LO01 Evaluates fundamental concepts such as artificial intelligence, machine learning, deep learning, algorithmic decision-making, and robotics from the perspective of administrative law principles.
LO02 Gains a general perspective on how public administrations make use of artificial intelligence.
LO03 Understands the advantages provided by artificial intelligence in the digitalization process of administration, as well as the potential problems it may cause.
LO04 Analyzes algorithmic decision-making processes from the perspective of the theory of administrative acts.
LO05 Examines the liability of the administration in terms of risks such as algorithmic bias and discrimination.
LO06 Questions the limits of delegating the administration’s discretionary power to algorithms.
LO07 Develops an understanding of what the general principles of an ideal legal framework should be regarding the use of artificial intelligence by the administration, in light of ethical principles and legal norms.
LO08 Conducts academic literature reviews on the relationship between artificial intelligence and administrative law.
