Course Goal / Objective

The course aims to examine the interaction between administration, ethics and morality within the framework of administrative law. It seeks to analyze the role of ethical values in public administration, the ethical rules governing public officials, and the principles of good administration developed within the framework of European human rights law. The course also aims to evaluate the ethical dimensions of fundamental rule-of-law principles in administrative law such as legal certainty, clarity, and non-retroactivity. In addition, the impact of populism and arbitrary governance on the rule of law and the ethical responsibilities of the administration are discussed in order to develop students’ critical evaluation skills in this field.

Course Content

The course examines the theoretical foundations of ethics and morality in public administration, ethical conduct principles for public officials, conflicts of interest, corruption, transparency and accountability. It also analyzes the principles of good administration developed in European human rights law and European Union law, including impartiality in administrative decision-making, the right to be heard, the duty to give reasons and the obligation to decide within a reasonable time. In the final part of the course, Lon Fuller’s theory of the internal morality of law is discussed in relation to administrative law problems such as rulelessness, vagueness, retroactivity and the obligation of administrative authorities to follow their own rules.
